Tre Kuvendet e Lugines se Presheves dalin me Deklarate Politike

Në seancën e mbajtur më 28 janar 2011, në Preshevë,

K U V E N D I

I KËSHILLTARËVE SHQIPTARË TË LUGINËS SË PRESHEVËS

aprovon këtë:

DEKLARATË POLITIKE

- Kuvendi shpreh indinjatën më të thellë ndaj aktgjykimit, politikisht të motivuar, të Gjykatës për krime lufte në Beograd ndaj nëntë shqiptarëve të Komunës së Preshevës. Kuvendi konsideron se mungesa e provave relavante materiale, mbështetja e aktgjykimit pothuajse vetëm në deklaratat e dëshmitarit bashkëpunëtor dhe dëshmitarëve indirekt e bëjnë atë të papranueshëm dhe juridikisht të paqëndrueshëm,

- Kuvendi kërkon shfuqizimin e këtij aktgjykimi nga gjykata më e lartë, duke patur parasysh motivimet e tij politike dhe mungesën e fakteve materiale, si dhe shkeljet e të drejtave të njeriut gjatë procesit të arrestimit dhe paraburgimit të nëntë qytetarëve të Preshevës,

- Kuvendi, shpreh mosbesim ndaj sistemin gjyqësor serb, veçmas duke iu referuar reformës së dështuar gjyqësore të kritikuar për centralizim të sistemit dhe refuzimit të vazhdueshëm të procesimit të krimeve që janë kryer ndaj qytetarëve shqiptarë në Luginë të Preshevës gjatë periudhës 1999 - 2001,

- Kuvendi e konsideron Aktgjykimin ndaj nëntë shqipëtarëve të komunës së Preshevës vazhdimësi të presionit sistematik të Beogradit zyrtar ndaj qytetarëve shqiptarë të Luginës së Preshevës, që si pasojë nxit shpërnguljen e Shqipëtarëve nga lugina e Preshevës,

- Kuvendi kërkon, që deri në shqyrtimin e ankesës së parashtruar nga pala mbrojtëse, lirimin e katër të akuzuarve shqiptarë të mbetur në paraburgim por edhe lirimin nga akuza të të gjithë të akuzuarve në këtë proces gjyqësor me motive politike,

- Kuvendi kërkon nga faktorët relevant ndërkombëtarë, të ushtrojnë presion tek organet shtetërore, në Beograd që krahas ndërprerjes së proceseve gjyqësore politikisht të motivuara të ndërprejë edhe të gjitha format e diskriminimit dhe presionit të vazhdueshëm shtetëror që po ushtrohet në Preshevë, Bujanoc dhe Medvegjë,

- Kuvendi deklaron që, në rast të mospërfilljes së kërkesave të parashtruara në këtë Deklaratë, do të shqyrtojë të gjitha format e veprimit politik deri në shprehjen e padëgjueshmërisë qytetare,

THE ASSEMBLY

OF THE ALBANIAN DELEGATES OF PRESHEVA VALLEY

approves the following:

POLITICAL DECLARATION

• The Assembly expresses the deepest indignation towards the verdict, politically motivated of the Court for war crimes in Belgrade towards nine Albanians of Presheva municipality. The Assembly considers that the lack of relevant material evidence, the verdict being based almost only to the statements of the witness as collaborator as well as to the indirect witnesses, make it unacceptable and lawfully unsustainable,

• The Assembly requests from the highest Court the repeal of this verdict, having into account the legal gaps and the lack of the material facts, as well as the violations of the human rights during the process of the arrest and detention of the nine Albanian citizens,

• The Assembly expresses the distrust towards the Serbian judicial system, especially referring to the failed judicial reform, criticized for the centralization of the system and the permanent refusal of the processing of crimes that were done towards the Albanian citizens in Presheva Valley during the period of 1999 – 2001,

• The Assembly considers the verdict towards nine citizens of Presheva municipality the continuation of the permanent pressure of the official Belgrade towards the Albanian citizens of Presheva Valley,

• The Assembly requests, that up to the reviewing of the appeal submitted by the defendant, the release of the four accused Albanians who remained in detention as well as the release from the accusation of all accused ones in this court process with political motives,

• The Assembly requests from the international relevant factors to exert pressure to the state institutions in Belgrade in order to terminate the court processes which are politically motivated, at the same time to terminate all the forms of discrimination as well as the permanent state pressure which is getting done in Presheva, Bujanoc and Medvegja,

• The Assembly declares that in case of non-respecting of the requirements set forth in this declaration, it will review all forms of political action till the expression of the civil disobedience.
